Terms & Conditions

Acceptance of these Terms: by checking "I agree to the Terms & Conditions and Privacy Policy" and starting a subscription, a DJ confirms they have read and agree to these Terms and our Privacy Policy. We do not treat browsing the website alone, without that explicit confirmation, as acceptance.

1. Who we are, and the two relationships involved

DJ Request Pro is a live song-request platform operated by South Media Group Ltd, a company registered in Christchurch, New Zealand ("DJ Request Pro", "we", "us", "our"). These Terms & Conditions ("Terms") cover two distinct relationships:

This distinction matters because it affects who is primarily responsible for fulfilling a paid request to a Guest — that responsibility sits with the DJ, with DJ Request Pro acting as a technology intermediary and, per Section 4, as the payment processing platform.

2. Definitions

"Paid Request" means a request submitted by a Guest for a DJ to play a specified song (or, at the DJ's discretion, a different version, remix, or edit of the same track) during the relevant event, subject to the DJ's acceptance.

A Paid Request is only charged once the DJ accepts it. Before acceptance, the Guest's payment method is authorised but not charged.

3. How a request works

  1. A Guest submits a request and, for a paid request, authorises payment on their card (this places a hold, it does not charge the card yet).
  2. The DJ reviews the request and either accepts or declines it within the time window shown to the Guest at the time of the request.
  3. If the DJ accepts: the payment is captured (the Guest is charged) and the DJ takes on responsibility for playing the song, per Section 6.
  4. If the DJ declines, or does not respond within the shown time window: the authorisation is released automatically and the Guest is not charged.

A Paid Request does not guarantee an exact playback time or set position beyond the timeframe shown to the Guest when they submitted the request.

Tips on free requests: when a DJ uses free-request mode, a Guest may add an optional tip to a request. A tip is not a payment for a specific play time: once the DJ accepts the request, the song may be played at any point during the event, at the DJ's discretion, to suit the music and energy of the event. A request is considered fulfilled when the song (or a version, remix, or edit of it) is played during the event, whether or not the Guest is still present at that time. A Guest leaving before the song is played is not, on its own, grounds for a refund.

4. Payments and Stripe Connect

Paid Requests are processed through Stripe. Payments from Guests are processed through DJ Request Pro's Stripe platform account and automatically transferred to the DJ's own connected Stripe account.

Service fee: when a Guest pays for a request or leaves a tip, a service fee is added on top of the price or tip set by the DJ. The service fee is shown to the Guest, together with the total, before they authorise the payment. It covers card payment processing and a platform fee of 3% of the price or tip, and is retained by DJ Request Pro. The DJ receives 100% of the price or tip they set; no commission or processing fee is deducted from it. DJs remain responsible for any other third-party charges applicable to their own connected payment account (for example, their bank's fees).

By accepting a Paid Request, the DJ takes on responsibility to play that song (or an alternate version, remix, or edit of the same track, which still counts as fulfilling the request) within the timeframe shown to the Guest. If a DJ cannot or should not play a requested song, the DJ should decline the request rather than accept it and not play it.

Music licensing: DJs and venues are solely responsible for obtaining any licences, permissions, or authorisations required for the public performance or use of music at their events. DJ Request Pro does not provide music licences or grant any rights to publicly perform any musical work or sound recording.

7. Refund policy

This policy applies when a DJ accepts a Paid Request, or a free request with a tip (and the Guest is charged), but the song is not played during the event. By accepting, the DJ takes responsibility for playing the song; if it is not played, the refund comes out of the DJ's earnings as described below.

Step 1 — DJ review

If a Guest believes an accepted Paid Request was not played, the DJ is responsible for reviewing the claim first and deciding in good faith whether a refund is warranted.

Step 2 — Escalation to DJ Request Pro

If the Guest is not satisfied with the DJ's response, the matter can be escalated to DJ Request Pro support. DJ Request Pro may review the information provided by the Guest and DJ and determine whether a refund should be processed through the Service. This process does not limit either party's rights or remedies under applicable law.

Step 3 — Processing an approved refund

If a refund is approved, the Guest will be refunded the price or tip they paid for that request. The service fee is not refundable, as it covers card processing costs that are not returned when a payment is refunded. The refunded price or tip will be deducted from the DJ's connected account or a future payout. No additional processing fee is deducted from the DJ.

Payments made before 1 October 2026, which did not include a service fee, are refunded under the policy in effect at the time: the Guest is refunded the full amount, and that amount — including any non-recoverable Stripe processing fee — is deducted from the DJ's connected account or a future payout.

Requests that were never accepted, or that expire

If a Paid Request is declined, or is not accepted within the shown time window, no charge is ever made — there is nothing to refund, as the authorisation is released automatically.

Event disruptions outside anyone's control

If an event ends unexpectedly after a request was accepted and charged (for example, the venue cuts the music, an evacuation, or a similar disruption), the claim will be reviewed under the same process above, taking the circumstances into account.

Timeframe

Refund claims should normally be submitted within 7 days of the relevant event, to allow the matter to be investigated promptly. This timeframe does not limit any rights or remedies available under the Consumer Guarantees Act 1993 or other applicable New Zealand law.

How to submit a claim

Contact DJ Request Pro support (Section 15) with the DJ's name, the event date, and details of the request in question.

8. New Zealand consumer law

Nothing in these Terms excludes, restricts, or modifies any rights or remedies that cannot lawfully be excluded under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other applicable New Zealand law. Where the Consumer Guarantees Act applies, the Service comes with guarantees that cannot be excluded under New Zealand law.

Where a DJ acquires the Service in trade for business purposes, the DJ agrees that the Consumer Guarantees Act 1993 does not apply to the supply of the Service (DJ Request Pro's software subscription to the DJ) to the extent that it is fair and reasonable for the parties to contract out of that Act. This does not apply to, and has no effect on, the rights of a Guest.

9. Instagram follow prompt

A DJ may choose to invite Guests to follow their Instagram profile as part of the request flow. DJ Request Pro may provide a link to the DJ's Instagram profile but does not verify whether a Guest actually follows the account.

10. Service availability

We aim to keep DJ Request Pro available and reliable but do not guarantee uninterrupted or error-free operation. The Service may occasionally be unavailable due to maintenance, third-party services (including Stripe), internet connectivity, security incidents, or circumstances outside our reasonable control.

11. Intellectual property

South Media Group Ltd owns or licenses all rights in the DJ Request Pro software, user interface, branding, logos, QR code system, databases, and website content. DJs retain ownership of content they upload (such as their own logo, photos, and event details) and grant DJ Request Pro a limited licence to display that content within the Service as needed to operate it.

12. Account suspension and termination

DJ Request Pro may suspend or terminate an account where reasonably necessary, including for fraud or suspected fraudulent activity, misuse of the Service, repeated or unresolved payment disputes, non-payment, security risks, unlawful activity, or material or repeated breaches of these Terms.

Where reasonably practicable, DJ Request Pro will provide notice of a suspension or termination and an opportunity to remedy the issue. Immediate suspension may occur where reasonably necessary to protect Guests, DJs, DJ Request Pro, Stripe, or the security and integrity of the Service.

14. Changes to these Terms

We may update these Terms where reasonably necessary to reflect changes to the Service, pricing, legal or regulatory requirements, security requirements, or our business operations. Where a change materially affects a DJ's rights, obligations, or subscription, we will provide reasonable notice before the change takes effect. If a DJ does not agree to a material change, they may cancel their subscription before the change takes effect.

16. Limitation of liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including any rights or remedies that cannot be excluded under the Consumer Guarantees Act 1993 or Fair Trading Act 1986. Subject to that, and to the maximum extent permitted by New Zealand law, DJ Request Pro is not liable for indirect, incidental, or consequential losses arising from use of the Service, including disputes between a DJ and a Guest that fall outside the refund process described in Section 7.

17. Governing law

These Terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the courts of New Zealand.
